Home and builder disputes on the rise

WYNDHAM is one of the worst areas in Victoria for disputes between homeowners and builders, according to statistics released by Consumer Affairs Victoria.
One hundred and forty-five complaints were made last year compared to 130 in 2009.
Wyndham was ranked fourth, behind Brimbank, Whittlesea and Casey.
A spokesperson for Consumer Affairs Victoria said it was important that residents know how to protect themselves when building a house.
“Building or renovating a home is a serious financial commitment,” the spokesperson said.
“For many families it will be the biggest investment they will ever make so it is essential that they know exactly what they are getting into and how to protect their investment.”
The most common cause of disputes between builders and homeowners is building products and fixtures being supplied that were different to what were specified in the contract and defective and incomplete work.
Concrete slabs, driveways and paths were the subjects of the most distress.
The spokesperson for CAV said there have been 12 prosecutions of dodgy builders in Victoria over the last year, with fines totalling $56,100 and compensation orders for consumers totalling $181,850.
The spokesperson said homeowners should discuss any issues they have with their builder before thinking about taking legal action.
“Raise an issue or concern you may have with the builder before it escalates to a dispute. Communication is your best tool,” the spokesperson said.
“Seek advice immediately and follow up on that advice as soon as possible. Taking action early is likely to prevent the dispute from escalating or further issues emerging.”
