A MAN who killed his wife’s lover in Brooklyn and set the body on fire went out for kebabs shortly after committing the murder.
The Supreme Court of Victoria recently sentenced Mark Budimir to 18 years in prison with a non-parole period of 16 years, for the murder of Dino Moresco in October 2011.
Justice Geoffrey Nettle said Mr Budimir, a father of four, was aged 41 when he killed his victim.
The court heard Mr Budimir’s wife Jana met Mr Moresco after she started purchasing items from his Brooklyn business for her Footscray nursery.
Justice Nettle said as Jana and Mr Moresco became closer, the Budimirs’ marriage came under “considerable stress”.
The court heard on 23 September 2011, Mr Budimir asked his wife not to abandon their marriage, but slapped her and locked her in a bedroom when she refused.
On 30 October 2011, he visited Mr Moresco’s factory and chased the other man, before assaulting him with a “power slam” seen “in wrestling” and standing on his chest.
The court heard Mr Moresco suffered from injuries including a broken nose, fractured rib, laceration of the liver “to the point that it was almost torn in half”, a bowel haemorrhage and a fractured hyoid bone.
After the assault, Mr Budimir put Mr Moresco’s body in a car and drove to an industrial site in Bunting St, Brooklyn.
Mr Budimir then drove to his parents’ Rockbank farm to collect petrol.
When Mr Budimir returned to Brooklyn, Mr Moresco was dead – so Mr Budimir put his victim into a wheelie bin, poured fuel on the body and set it alight.
He then drove to Millers Rd and purchased some kebabs.
The following morning, Mr Budimir contacted his wife and “told her emphatically” that he had “got rid of the deceased”.
Mr Budimir fled interstate and was arrested by New South Wales police shortly afterwards.
Justice Nettle said although Mr Budimir had been traumatised by his wife’s infidelity and pleaded not guilty, it would take many years in prison for him to understand the “moral responsibility” for his crimes.
